Monday, October 26, 2015. Aaron Humes Reporting: Senior Magistrate Sharon Frazer today dismissed a plea of guilty by one-half of a feuding couple and said she would have full trial of charges of aggravated assault, wounding and damage to property.
Tonight, 28 year old truck driver, Jose Alfredo Barrera, who pleaded guilty to the charges, is out on bail after Magistrate Fraser entered an equivocal plea of not guilty against him.
Barrera is accused and as of now admits that he cut his common-law wife with hits from a wheel spanner, causing wounds, and broke the screen of her white Samsung Galaxy S3 cellular phone while arguing with her on Sunday, October 25 at their home.
An unrepresented Barrera said that he left home the Saturday and told his wife that he was going to Big Creek to work. Barrera returned to the City around midnight Sunday morning.
He recalled that whilst out on the job, his wife called saying she had a meeting to go to and that she would quickly step out and return, leaving their two children home.
But according to Barrera he found his 12 year old daughter and son were home alone and the older child said that their mother just left with a male co-worker from 9 the Saturday night and told them nothing. She did not respond to his calls to her phone around 1:45 in the morning, and upon her return home, he began to question her and observed that she was drunk and could barely stand on her own.
They began to argue and then to fight, as his wife pulled the spanner and then they began to hit each other. She began to bleed from one of her wounds, he became concerned and tried to take her phone from her but that’s when the phone screen broke, not intentionally.
